Tesla Files Lawsuit Against Indian Battery Company Over Trademark Infringement
Tesla, Inc., led by CEO Elon Musk, has initiated legal action in India against a domestic battery company named Tesla Power, alleging trademark infringement.
Cease-and-Desist Letter Goes Unheeded
Two years ago, Tesla, Inc. issued a cease-and-desist letter to Tesla Power India, headquartered in Gurgaon and also operating as Tesla Power USA in Delaware. Despite this, the Indian company continued to use the Tesla name, prompting the lawsuit.
Defense Argument
In response, Tesla Power India argued in a hearing at the Delhi High Court that it specializes in manufacturing lead acid batteries and has no intentions of entering the electric vehicle (EV) industry.
Company Mission
According to its website, Tesla Power India aims to become the top brand in India’s energy storage sector by 2025, focusing on innovation, sustainable products, and affordability.
Lengthy Presence in India
Tesla Power India emphasized that it has been operating in India for a significant period, predating Elon Musk’s Tesla’s presence in the country.
Legal Proceedings
Tesla, Inc.’s senior counsel, Chander Lall, highlighted the confusion caused by Tesla Power India’s use of the Tesla name, citing negative impacts on Tesla, Inc.’s business and customer relations.
Court Decision
The judge issued an interim order barring Tesla Power from using the Tesla name in promotions until the next hearing on May 22. During this time, Tesla Power is required to provide written responses defending its position.
Background Context
The lawsuit follows Elon Musk’s recent cancellation of a meeting with Indian Prime Minister Narendra Modi in favor of visiting China, where discussions were held regarding the deployment of Tesla’s advanced driver-assistance features.
